Terms relating to purchase

All goods and services (collectively, “Products”) which you order and/or purchase through the web site are subject to the following terms and conditions.

All references to “$”, “dollars”, “NZ$” or “NZD” are references to New Zealand Dollars, which is the currency used for all purposes on the web site.

All Products are sold to you on an as-is where-is basis, without any representations and warranties, except for any representations and warranties that may not be excluded by applicable law. The Wilmar Group hereby disclaims all representations and warranties in relation to the Products to the maximum extent permitted by applicable law.

Title to the Products passes to you when the Wilmar Group receives payment for the Products.

The Wilmar Group will use commercially reasonable endeavours to ensure that the Products which you have purchased are physically delivered to you by the time stipulated on this web site, or, if no such time is stipulated, within a reasonable time, subject to the rest of this clause. Notwithstanding any term to the contrary, the Wilmar Group shall not be liable for any failure or delay in the performance of its obligations where such failure or delay arises or results from or is caused by any circumstance or event beyond the Wilmar Group’s reasonable control, including acts of God, war, Government order, strikes, natural disasters and embargos.

The Wilmar Group’s liability to you in relation to the Products is limited to either (a) providing you with a replacement Product or (b) issuing you a credit or refund (as applicable) for the Product, as determined by the Wilmar Group in its sole discretion. The Wilmar Group will not be liable to you for any consequential, indirect or special losses or damages, including any loss of profit, revenue or goodwill.

The Wilmar Group’s maximum aggregate liability to you is limited to the total amounts paid by you to the Wilmar Group in the 12 months prior to the date on which the cause of action arose.
